Our Terms of Use explain the rules for using MovIQ Health’s website and services. By visiting or using this site, you’re agreeing to those rules, so we can provide safe, respectful, and professional service for everyone.

Welcome to MovIQ Health. These Terms of Use (“Terms”) are a legally binding agreement between you and GaitLab LLC, a Nevada limited liability company doing business as (DBA) MovIQ Health (“MovIQ,” “we,” “us,” or “our”). These Terms govern your access to and use of all services, websites, mobile applications, assessments, reports, and other offerings provided under the MovIQ Health brand.
By accessing or using any part of our services, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy. If you do not agree to these Terms, you may not access or use the services.
These Terms apply to all users of our services, including clients, patients, healthcare professionals, caregivers, and any other individuals accessing the MovIQ Health platform. If you are using the services on behalf of another person or entity, you represent and warrant that you are authorized to do so and agree to these Terms on their behalf.
1. Eligibility
MovIQ Health’s services are intended for use by adults who are 18 years of age or older. By accessing or using any part of our services, including scheduling an appointment, registering for an account, participating in an assessment, or receiving a report, you represent and warrant that you are at least 18 years old.
MovIQ Health membership and services are strictly limited to individuals aged 18 and older. This includes, but is not limited to:
In-person movement assessments
Digital reports or dashboards
MovAge and MovScores tracking
Any current or future subscriptions, memberships, or online health tools
If you are under the age of 18, you are not permitted to create an account, register for services, or engage with any part of MovIQ Health’s offerings on your own behalf.
However, minors (under 18) may only access certain services if:
A parent or legal guardian provides explicit written consent;
And such participation is compliant with all applicable laws and medical standards.
Currently, MovIQ Health does not provide pediatric evaluations or services for individuals under 18. We reserve the right to cancel or restrict any access if we become aware that services are being used in violation of this policy.
If you misrepresent your age or provide false information to gain access to MovIQ Health’s services, your access may be terminated immediately, and you may be subject to legal liability.
2. Services Provided
MovIQ Health provides a range of mobility-focused services designed to assess, track, and support your physical function through advanced biomechanics technology. Our services are intended to promote proactive health insights, encourage early detection of functional decline, and empower individuals to take an active role in preserving their mobility and independence as they age.
Our offerings are built around the principle that movement is a vital sign - a measurable, trackable indicator of overall health. We aim to bridge the gap between subjective movement evaluations and objective, clinical-grade data.
Our services include, but are not limited to:
MovIQ Assessments
Comprehensive evaluations conducted by a licensed physical therapist using motion capture systems, force plates, and balance plate. These assessments provide objective insight into gait, strength, and balance.MovIQ Reports
After each assessment, clients receive a personalized report containing detailed movement metrics and visualizations. These reports include standardized scores such as MovAge and MovScores to quantify mobility status, identify areas of concern, and highlight opportunities for improvement.Educational Tools & Recommendations
Clients receive tailored guidance and evidence-based recommendations to help improve mobility, balance, strength, and overall movement quality. This may include general activity suggestions, ergonomic tips, and referrals to other health professionals when appropriate.Secure Digital Access
Where applicable, clients may access their reports and progress securely online through a client portal, subject to availability and platform development.

Medical diagnoses
Treatment plans
Prescriptions
Emergency care
Our assessments and reports are informational and intended to complement, not replace, clinical care. Always consult with your physician, physical therapist, or other qualified healthcare provider before starting, stopping, or modifying any healthcare or movement-related activity based on insights from MovIQ Health.
We do not guarantee specific health outcomes or the prevention of injury or disease. Results and insights are based on the accuracy and consistency of the data collected at the time of your assessment.
3. User Accounts
To access certain features or services provided by MovIQ Health such as scheduling appointments, viewing reports, tracking progress, or receiving personalized recommendations, you may be required to create a user account through our website, mobile application, or digital platform.
By creating and maintaining an account with MovIQ Health, you agree to the following:
a) Provide Accurate and Current Information
You agree to provide true, complete, and up-to-date information during the account registration process and to update your information promptly if it changes. MovIQ Health is not responsible for any issues or miscommunications arising from outdated or inaccurate user data.
b) Maintain Confidentiality of Login Credentials
You are solely responsible for maintaining the confidentiality and security of your login credentials, including your username and password. You agree not to share your account or password with others, and you must take reasonable steps to protect your account from unauthorized access.
c) Notify Us of Unauthorized Access
If you suspect or become aware of any unauthorized use of your account, a security breach, or any other suspicious activity, you must notify us immediately at info@moviqlyhealth.com. MovIQ Health is not liable for any losses or damages arising from unauthorized account use that occurs before such notification is made.
d) Responsibility for Account Activity
You are fully responsible for all activities that occur under your account, including any actions taken by individuals who gain access through your credentials. This includes the use of services, accessing sensitive personal data, and communications made through the platform.
e) Third-Party Account Access (Authorized Representatives)
In certain cases, users may authorize a third party such as a caregiver, healthcare provider, legal guardian, or power of attorney to access and manage their MovIQ Health account on their behalf.
By granting such access, you:
Represent that the authorized individual has legal standing to act on your behalf;
Acknowledge that any actions taken by the third party will be considered as having been taken by you;
Accept full responsibility for all activity performed through your account, including access to personal health information, appointment management, and communication with MovIQ Health staff.
We reserve the right to request documentation verifying legal authority (e.g., guardianship papers, HIPAA authorization, or power of attorney) before allowing a third party to act on a user’s behalf. Unauthorized third-party access is strictly prohibited.
If you are accessing a MovIQ Health account on behalf of another person, you represent and warrant that you have all necessary legal permissions to do so. Misrepresentation of authority may result in immediate suspension of account access and possible legal consequences.
f) Account Termination & Data Retention
You may request to deactivate or permanently delete your MovIQ Health account at any time by contacting us at info@moviqhealth.com. Once your request is verified, we will process your account closure in accordance with applicable laws and our data handling policies.
Upon termination:
Access to your account and services will be revoked.
Any upcoming appointments will be canceled, and you may be subject to cancellation fees as outlined in our policies.
MovIQ Health will retain your assessment data, reports, and related information for a period required by applicable healthcare, tax, and data retention laws (e.g., HIPAA).
We may retain anonymized, de-identified data indefinitely for internal research, analytics, or service improvement purposes. This information will not contain any personally identifiable information and cannot be used to identify you.
MovIQ Health reserves the right to suspend or terminate accounts without prior notice if:
We suspect fraud, unauthorized access, or abuse of our platform;
Terms of Use are violated;
Required by law or regulatory authority.
We reserve the right to suspend, terminate, or restrict your access to MovIQ Health services at our sole discretion if we determine that your account has been compromised, misused, or associated with suspicious or fraudulent activity.
4. Appointments & Cancellations
MovIQ Health provides all in-person services, including movement assessments and consultations, by appointment only. Timely scheduling, communication, and attendance are essential to ensure the quality of your experience and to maintain efficient operations for all clients.
By booking a session with MovIQ Health, you agree to the following terms:
a) Timely Arrival
You agree to arrive on time for all scheduled appointments. If you anticipate being late, please notify us as soon as possible. We reserve the right to shorten or reschedule your appointment if you arrive more than 15 minutes late, depending on staff availability and clinic capacity.
b) Advance Notice for Cancellations or Rescheduling
If you need to cancel or reschedule an appointment, you agree to provide at least 24 hours’ advance notice by contacting us through the appropriate channel (email, phone, or online portal, if available). This allows us to offer your appointment slot to another client in need.
c) Late Cancellations and Missed Appointments
Failure to attend a scheduled appointment or canceling with less than 24 hours’ notice is strongly discouraged, as it limits our ability to offer that time to others. While MovIQ Health does not charge fees for late cancellations or no-shows, repeated missed appointments or last-minute cancellations may result in the restriction or suspension of your ability to book future appointments.
We appreciate your cooperation in notifying us as early as possible if you are unable to attend your session.
d) Our Right to Reschedule
MovIQ Health reserves the right to reschedule or cancel appointments due to provider availability, equipment issues, emergencies, or other unforeseen circumstances. In such cases, we will make reasonable efforts to notify you in advance and offer a rescheduled date at no additional charge.
e) Refund Policy for Appointments
Unless otherwise stated, all fees paid for appointments are non-refundable once the session has begun. Cancellations made in accordance with this policy (i.e., with appropriate notice) may be eligible for a full or partial refund, credit, or rescheduling option at our discretion.
5. Membership & Payment Policy
MovIQ Health offers services exclusively through an annual membership model. This structure is designed to support ongoing engagement, consistent tracking, and long-term improvements in mobility health.
a) Annual Membership Model
By enrolling in a MovIQ Health membership, you gain access to a defined set of services for a full 12-month period. This may include:
A comprehensive initial mobility assessment
One or more reassessments (e.g., quarterly or semi-annually)
Secure access to digital reports and MovAve and MovScores tracking
Periodic educational content and wellness guidance
Specific inclusions may vary depending on the membership tier selected at the time of enrollment and will be clearly outlined in your onboarding materials.
b) All-Inclusive Access - No Per-Session Charges
There are no additional charges for individual sessions or assessments. Your membership fee covers all eligible services during the membership term. Once your membership is active and paid in full, you will not be billed separately for each visit or reassessment.
c) Payment Terms
Membership fees are due in full at the start of your 12-month term unless otherwise stated in writing. We may offer installment plans or promotional pricing from time to time. All payment methods must be valid, authorized, and kept up to date.
Failure to complete payment may result in suspension of access to services until payment is resolved.
d) Membership Renewal and Cancellation
Memberships will auto-renew at the end of each 12-month term unless you cancel in advance. You will receive a reminder before your renewal date.
If you wish to cancel your membership and avoid renewal charges, you must submit a cancellation request at least seven (7) days prior to the end of your current membership term. Cancellation requests received less than 7 days before renewal may not be processed in time to prevent renewal billing.
Cancellations or refunds are not guaranteed and are handled on a case-by-case basis. Please contact us at info@moviqhealth.com if you have questions regarding changes to your membership.
6. Use of Information
By using MovIQ Health’s services, you acknowledge and agree that we will collect, store, and use certain personal information and movement-related data in order to deliver accurate assessments, generate individualized reports, and support your long-term mobility health journey.
a) Consent to Data Collection and Use
You expressly consent to MovIQ Health collecting, processing, and analyzing data generated during your use of our services—including in-person assessments, movement tests, and digital interactions—for the purpose of:
Creating personalized MovIQ Reports
Tracking changes and trends in your mobility over time
Identifying areas of improvement or early indicators of decline
Delivering tailored recommendations and insights
This may include video or motion capture files, force plate data, balance and gait measurements, session notes, and other biomechanical metrics.
b) Data Security and Compliance
All personal data collected by MovIQ Health is securely stored using industry-standard encryption and access controls. We are committed to maintaining the confidentiality, integrity, and availability of your data.
We handle your information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable federal, state, or local privacy laws. Only authorized personnel and systems with a legitimate need are permitted to access your personal health information (PHI).
c) De-Identified and Aggregated Data
MovIQ Health may de-identify and aggregate user data in a manner that removes all personally identifiable information (PII), such as names, dates of birth, contact information, and any other identifiers. This anonymized data may be used for:
Research and development
Service optimization
Internal analytics and benchmarking
Clinical validation and quality improvement
De-identified data will never be used in a way that allows you to be re-identified, and will not be shared or sold to third parties for marketing purposes.
If MovIQ Health wishes to use identifiable information for any other purpose not outlined here (e.g., external research, testimonials, or case studies), we will obtain your explicit, written consent before doing so.
d) Your Rights
You have the right to:
Request access to the personal data we hold about you
Correct inaccurate or outdated information
Request deletion of your data, subject to legal retention requirements
Revoke consent to data processing (which may limit your access to services)

7. Intellectual Property

Website and app content, layout, design, graphics, and user interface
Logos, brand names, trademarks, and service marks
Written materials, educational content, reports, and scoring methodologies
Software code, algorithms, and proprietary technology
Photographs, videos, motion graphics, and assessment outputs
a) Ownership Rights
All intellectual property rights—whether registered or unregistered—are retained by MovIQ Health or its licensors. Nothing in these Terms of Use grants you ownership of, or a license to, any MovIQ Health intellectual property, unless explicitly stated in writing.
b) Restrictions on Use
You agree not to:
Reproduce, copy, modify, or distribute any part of our content or platform
Create derivative works or competing services based on our proprietary technology, scoring systems, or reports
Use our logos, brand identity, or name without express written permission
Reverse engineer, decompile, or attempt to extract source code from our software or digital tools
Any unauthorized use of MovIQ Health’s intellectual property may violate copyright, trademark, and other applicable laws, and may result in legal action, including injunctions and claims for damages.
c) Permitted Use
You may download, view, or print your own assessment reports or personalized results for personal, non-commercial use. Any other use—such as sharing, publishing, or repurposing our content for commercial, educational, or public distribution—requires prior written authorization from MovIQ Health.

8. Prohibited Conduct
By using MovIQ Health’s services, website, applications, and digital tools, you agree to use them in a responsible, ethical, and lawful manner. To maintain a safe and secure environment for all users, the following behaviors are strictly prohibited.
You agree not to:
a) Use the Services for Unlawful Purposes
Engage in any activity that violates applicable federal, state, local, or international laws or regulations
Use MovIQ Health to facilitate or promote illegal activity, fraud, or misrepresentation
Misuse or falsely represent health data for deceptive or unlawful gain
b) Access or Modify Another User’s Data
Attempt to access, view, modify, or use another individual’s personal data or reports without explicit authorization
Impersonate another user, client, employee, or representative of MovIQ Health
Circumvent authentication protocols or data security systems
c) Upload Malicious Code or Harmful Content
Upload, share, or transmit any files or code that contain viruses, malware, spyware, ransomware, or any other harmful software
Attempt to disrupt, overload, damage, or impair the operation of our platform, network, or devices
Use automated scripts, bots, scrapers, or crawlers to extract data or interact with our services in ways not intended by our design
d) Interfere with Our Systems or Services
Attempt to disrupt the availability, performance, or functionality of the MovIQ Health platform
Interfere with service delivery to other users
Engage in probing, scanning, or testing the vulnerability of our systems or networks without authorization
e) Abuse or Harass Staff or Other Users
Engage in threatening, abusive, discriminatory, or harassing behavior toward MovIQ Health staff, providers, or other clients
Use the platform to transmit or post offensive, defamatory, or objectionable content
Enforcement and Suspension of Access
MovIQ Health reserves the right to monitor user activity and enforce these terms. We may suspend, restrict, or permanently terminate your access to some or all of our services without prior notice if we determine that you have violated these Terms, abused the platform, or posed a risk to our systems, staff, or other users.
Violations may also result in legal action, civil liability, or referral to law enforcement, as appropriate.
9. Disclaimers
a) Informational Nature of Services
MovIQ Health provides mobility assessments and related services for informational and educational purposes only. Our goal is to help individuals better understand their movement patterns, identify potential risk factors, and take proactive steps toward improving their physical function.
We do not provide medical care, diagnosis, or treatment.
No part of our services—including assessments, reports, recommendations, or MovAge and MovScores—should be interpreted as a medical diagnosis, physical therapy treatment plan, or a substitute for professional medical advice from a licensed healthcare provider.
Always consult your physician or other qualified medical professional if you have any health-related concerns, experience pain or injury, or are considering changes to your exercise, mobility, or rehabilitation regimen.
b) No Guarantees or Outcome Promises
While we strive to provide accurate, high-quality assessments using advanced technology, you acknowledge and agree that MovIQ Health makes no guarantees or warranties of any kind regarding the results of our services.
This includes, but is not limited to:
Specific Health Outcomes
We do not guarantee improvement in balance, gait, strength, injury prevention, or any other medical or physical condition as a result of using our services.Accuracy of Data
Assessment results may be influenced by individual behavior, physical condition, measurement variability, sensor limitations, or environmental factors. While we use clinical-grade tools, perfect accuracy cannot be guaranteed, and MovIQ Health is not responsible for the impact of external variables on recorded data.Fitness for a Particular Purpose
Our services are not tailored to diagnose or treat medical conditions, and we make no representations that they are suitable for every user’s personal, clinical, or therapeutic goals.
c) Services Provided “As Is”
All services are provided on an "as is" and "as available" basis. MovIQ Health disclaims all express or implied warranties, including but not limited to:
Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or availability of the platform
We do not warrant that the services will be uninterrupted, timely, secure, or error-free. Your use of our services is at your own risk.
10. Assumption of Risk
By participating in any in-person assessment, movement screening, or related service offered by MovIQ Health, you acknowledge and voluntarily accept the inherent risks associated with physical activity, biomechanical testing, and mobility evaluations.
a) Physical Risk Acknowledgment
Although MovIQ Health assessments are non-invasive and designed with safety in mind, they may involve:
Standing, walking, balancing, or transitioning between positions
Wearing motion sensors or participating in movement analysis on force and balance plates
Performing mild to moderate physical activity under observation
These activities may pose a risk of physical discomfort, fatigue, muscle soreness, dizziness, imbalance, or—in rare cases—injury, particularly if you have a pre-existing condition or have not consulted with a healthcare provider.
You acknowledge that:
You are voluntarily participating in MovIQ Health assessments
You have disclosed any relevant medical conditions, recent injuries, or movement limitations prior to participation
You assume full responsibility for your participation and any resulting consequences, whether foreseeable or not
b) Personal Responsibility
You are solely responsible for determining whether your current health status allows for safe participation in a MovIQ Health assessment. If you experience any pain, discomfort, or adverse symptoms during an assessment, it is your responsibility to stop immediately and notify the staff.
MovIQ Health strongly encourages you to consult with your physician or other licensed medical professional before undergoing any assessment if you have:
Chronic illness or recent surgery
Balance issues or mobility impairments
Neurological, cardiovascular, or musculoskeletal conditions
Any condition for which physical exertion may pose a risk
c) Limitation of Liability
To the fullest extent permitted by law, you agree that MovIQ Health and its employees, contractors, and affiliates shall not be liable for any injury, loss, or damage arising out of or related to your participation in assessments or use of services—unless directly caused by gross negligence or willful misconduct.

To the maximum extent permitted by applicable law, MovIQ Health and its officers, employees, contractors, affiliates, agents, partners, licensors, and service providers shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to:
Loss of data or business interruption
Personal injury, pain or suffering
Emotional distress or reputational harm
Loss of revenue, profits, goodwill, or anticipated savings
Costs of substitute services or technology
Any other losses arising from your use of, or inability to use, our services
This limitation applies to damages resulting from, but not limited to:
Your use or reliance on any content, information, or reports generated through MovIQ Health’s platform or in-person assessments
Your inability to access or use our services due to system outages, connectivity issues, or service interruptions
Errors, omissions, or delays in data reporting, including inaccuracies resulting from equipment limitations, user input, or environmental factors
Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our systems by any third party
Unauthorized access to or alteration of your data or transmissions
Even if MovIQ Health has been previously advised of the possibility of such damages, these limitations will still apply.
Maximum Liability
To the extent permitted by law, **MovIQ Health’s total cumulative liability for any claims arising out of or related to these Terms, your use of the services, or any act or omission by us—regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise—shall not exceed the total amount you have paid to MovIQ Health for services in the twelve (12) months preceding the claim.
If you have not paid MovIQ Health for any services during that time, our total liability shall be limited to one hundred U.S. dollars (USD $100).
Jurisdictional Exceptions
Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such cases, the above limitations may not apply to you in full, but shall apply to the fullest extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless MovIQ Health, including its officers, directors, employees, contractors, licensors, affiliates, subsidiaries, agents, and representatives (collectively, the "Indemnified Parties"), from and against any and all claims, liabilities, losses, damages, demands, judgments, costs, expenses, or fees (including reasonable attorneys’ fees and legal costs) that arise from or relate to:
a) Your Use of the Services
Any use or misuse of MovIQ Health’s website, platform, assessments, or reports by you or anyone using your account, whether or not authorized;
Any activity in connection with your use of our services that violates applicable laws, regulations, or third-party rights.
b) Violation of These Terms
Your breach or alleged breach of these Terms of Use, Privacy Policy, or any other written agreement with MovIQ Health;
Any misrepresentation you make to MovIQ Health regarding your identity, health status, or eligibility to use the services.
c) Misuse or Disclosure of Data
Any unauthorized use, transmission, or disclosure of personal or protected data, including your failure to maintain the confidentiality of your account credentials;
Any actions you take that violate HIPAA, data privacy regulations, or infringe on the rights of another user or third party.
Defense and Control of Claims
MovIQ Health reserves the right, at its own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. In such cases, you agree to cooperate fully with our defense of those claims, including providing any information, records, or testimony reasonably requested.
You may not settle any matter subject to indemnification without the prior written consent of MovIQ Health, unless such settlement:
Fully releases all Indemnified Parties from liability, and
Does not impose any financial or legal obligations on MovIQ Health.
13. Changes to These Terms
MovIQ Health may revise, update, or modify these Terms of Use from time to time to reflect changes in our services, legal requirements, operational practices, or for any other reason deemed necessary at our sole discretion.
a) Notification of Changes
When we make material changes to these Terms, we will make reasonable efforts to notify you by:
Sending an email to the address associated with your account, and/or
Posting a prominent notice on our website or platform dashboard.
Material changes are those that significantly affect your rights, obligations, or the way we operate. Examples include changes to billing practices, user rights, data usage, or dispute resolution processes.
For minor or administrative updates (e.g., clarifications, grammatical corrections, or formatting changes), we may update the Terms without direct notification, but we will always reflect the most recent version and “Effective Date” at the top of this document.
b) Your Continued Use Constitutes Acceptance
By continuing to access or use MovIQ Health’s services after any changes become effective, you agree to be bound by the revised Terms. If you do not agree with the new Terms, your only recourse is to discontinue use of the services and, if applicable, cancel your membership.
It is your responsibility to review these Terms periodically for any updates. The most current version of the Terms will always be available on our website.
14. Governing Law
These Terms of Use, and any dispute or claim arising out of or relating to them, their subject matter, or the use of MovIQ Health’s services, shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
By using our services, you agree that:
Any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Clark County, Nevada, unless otherwise mutually agreed in writing.
You hereby irrevocably submit to the jurisdiction of such courts and waive any objection to venue or jurisdiction based on inconvenience or any other reason.
Nothing in this section shall limit MovIQ Health’s right to seek injunctive or equitable relief in any court of competent jurisdiction, including to prevent the unauthorized use of its intellectual property or breach of confidentiality obligations.
Any disputes shall be resolved in the courts located in [Insert County, State], unless otherwise agreed upon in writing.
