Moviq Health Terms of Service
Effective Date: October 17th, 2025
Welcome to Moviq Health. These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” or “User”) and Moviq Health (“Moviq Health,” “we,” “our,” or “us”), a Delaware C-Corporation.
These Terms govern your access to and use of the Moviq Health website, assessment services, digital dashboard, reports, consultations, and any related features or services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Moviq Health provides biomechanics-based assessments designed to help identify fall risk and support active aging. The Services are informational and educational only and are not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional about your health or medical conditions.
1. Acceptance of Terms
1.1 Agreement
By accessing, booking, or using the Services, you acknowledge you have read, understood, and agree to these Terms and our Privacy Policy.
1.2 Updates
We may revise these Terms from time to time. If we make material changes, we’ll notify you (e.g., website notice, email, or dashboard message). Your continued use after the effective date constitutes acceptance.
1.3 Supplemental Terms
Some Services may include additional terms (e.g., consent forms, promotions, research agreements). If there’s a conflict, the Supplemental Terms govern for that Service.
1.4 Third-Party Services
Our Services may integrate third-party tools (e.g., payment processors, hosting, video platforms). Those providers have their own terms and policies. We are not responsible for third-party content, practices, or failures.
2. Services Provided
2.1 Assessments & Reports
We offer in-person biomechanical assessments (e.g., gait, balance, force-plate metrics) at designated facilities. After your assessment, you’ll receive secure access to a digital dashboard with reports that may include:
A Fall Risk Index (0–100)
Projected Annual Fall Frequency
A “Window of Opportunity” (a forward-looking estimate)
Biomechanical insights, benchmarks, and comparisons
2.2 Consultations
Each assessment includes a consultation with a licensed physical therapist (“PT”) to review results, explain findings, and offer general wellness recommendations. Consultations are educational and not diagnostic medical evaluations.
2.3 Scope & Limitations
Services provide probabilistic insights and may not predict individual outcomes. We do not provide emergency care. For urgent concerns, contact your medical provider or emergency services.
2.4 User Responsibility
You are solely responsible for your health decisions. Use reports responsibly and consult your healthcare providers before making changes to treatment, exercise, or lifestyle.
3. Eligibility
3.1 Age
You must be 18+ to use the Services.
3.2 Minors
We do not provide Services to individuals under 18.
3.3 Geography & Licensure
Services are available only where Moviq Health operates and where licensed PTs are authorized to practice. You are responsible for complying with local laws.
3.4 Safety
We may decline Services if participation poses safety risks.
4. User Responsibilities
Accurate Information: Provide truthful, complete information when booking or creating an account.
Safe Participation: Follow staff/PT instructions. Stop and notify staff if you feel pain, dizziness, or discomfort.
Use of Reports: Reports and consultations are informational tools; do not treat them as medical facts or substitutes for clinical care.
Account Security: Safeguard your credentials; you’re responsible for activity under your account. Notify us of suspected unauthorized use.
Prohibited Conduct: Do not misuse, copy, reverse-engineer, scrape, or resell the Services or reports; do not provide false information; do not use the Services unlawfully.
Compliance: Follow all applicable laws.
5. Booking, Payments, and Refunds
5.1 Booking
Assessments must be booked through authorized Moviq channels. Appointments are confirmed upon full payment.
5.2 Pricing
Unless otherwise stated, each assessment (including PT consultation and reports) is $249.
5.3 Payment
Payment is due at booking via accepted methods provided by third-party processors.
5.4 Cancellation & Rescheduling
You may cancel or reschedule any time before the appointment start time. Payments for canceled appointments may be refunded or applied to a rescheduled date.
5.5 Refunds
Refunds are available only if (a) payment was made in full and (b) Services were not used. Requests must be submitted within 30 days of payment. No refunds after Services are provided or after 30 days (whichever occurs first), except where required by law.
5.6 Processors
Payments are processed by third parties (e.g., Stripe). You are subject to their terms and policies. We are not responsible for third-party errors or outages.
6. Intellectual Property
6.1 Ownership
All software, algorithms, dashboards, reports, documentation, trademarks, and content made available through the Services are owned by Moviq Health or its licensors.
6.2 License
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use your reports for personal, non-commercial use only.
6.3 Restrictions
You may not copy, distribute, modify, translate, create derivative works, reverse-engineer, decompile, scrape, or exploit Moviq Content without our prior written consent.
6.4 Feedback
If you provide feedback or suggestions, we may use them without obligation, attribution, or compensation.
7. Privacy and Data Use
7.1 Privacy Policy
Your personal information and assessment data are governed by our Privacy Policy.
7.2 Data We Collect
We collect personal information and biomechanical data during booking and assessments (e.g., gait, balance, force metrics, kinematics).
7.3 How We Use Data
We use assessment data to deliver Services, generate reports, and provide consultations. We may use de-identified/aggregated data for validation, quality improvement, and product development as described in the Privacy Policy.
7.4 Security
We employ administrative, technical, and physical safeguards appropriate to the nature of the data. However, no system is 100% secure, and you acknowledge inherent risks in data transmission and storage.
7.5 Sharing
We share data only as needed to deliver Services or comply with law (e.g., PTs for consultations; hosting/payment vendors; lawful requests).
7.6 Your Rights
You may request access, correction, or deletion of your data (subject to legal retention requirements). See Privacy Policy for details.
8. Disclaimers
Informational Use: Services are for informational/educational purposes only—not medical advice, diagnosis, or treatment.
No Provider Relationship: Use of Services does not create a provider–patient or therapist–patient relationship beyond the limited PT consultation.
No Outcome Guarantees: We do not guarantee prevention of falls or any specific results; reports are probability-based estimates.
As-Is / As-Available: Services are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness, accuracy, reliability, or non-infringement).
Technology Limits: Interruptions or errors may occur, including those caused by third-party platforms. We are not responsible for such failures.
9. Limitation of Liability
To the fullest extent permitted by law, Moviq Health and its affiliates, officers, directors, employees, contractors, advisors, and agents (the “Moviq Parties”) are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including personal injury, medical costs, lost profits, lost data, business interruption, or emotional distress, arising from or related to the Services.
Cap on Liability: The total liability of the Moviq Parties for all claims shall not exceed the amount you paid for the Services giving rise to the claim; if you did not pay, liability is capped at $100. Some jurisdictions do not allow certain limitations; where prohibited, the limitations apply to the maximum extent permitted.
Assumption of Risk: You understand that physical assessments carry inherent risks (e.g., soreness, fatigue, imbalance, falls) and voluntarily assume those risks.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Moviq Parties from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms or law; (c) your misuse of reports or consultations; or (d) third-party claims related to your conduct. We may assume exclusive defense at your expense; you will cooperate and not settle without our written consent.
11. Termination
We may suspend or terminate access if you violate these Terms, misuse the Services, or create legal/security risks. You may stop using the Services at any time and request account closure. Upon termination, your access ceases and we may deactivate/delete your account and data subject to law and our Privacy Policy. Fees already paid are non-refundable unless otherwise stated here or required by law. Sections intended to survive (e.g., IP, Privacy, Disclaimers, Liability, Indemnity, Governing Law, Disputes) will continue.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles.
12.2 Venue
Subject to arbitration below, the exclusive venue for any action not subject to arbitration is the state or federal courts located in New Castle County, Delaware, and you consent to their personal jurisdiction.
12.3 Arbitration
Except for claims eligible for small-claims court or for injunctive/equitable relief protecting IP or confidential information, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat of arbitration is Las Vegas, Nevada, unless both parties agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.
12.4 Class Action & Jury Waivers
Disputes must be brought on an individual basis; no class or representative actions. You and Moviq Health waive the right to a jury trial.
12.5 Equitable Relief
We may seek injunctive or equitable relief in any court of competent jurisdiction to protect IP, confidential information, or proprietary rights without first arbitrating.
13. Changes to Terms
We may update these Terms at any time. Changes take effect upon posting or as otherwise stated in the notice. Continued use constitutes acceptance.

15. Miscellaneous
Entire Agreement: These Terms, the Privacy Policy, and applicable Supplemental Terms are the entire agreement and supersede prior communications.
Severability: If any provision is invalid, the rest remain in effect.
No Waiver: Failure to enforce a provision is not a waiver.
Assignment: You may not assign these Terms without our consent; we may assign freely (e.g., merger, acquisition, asset sale).
Headings: For convenience only and not interpretive.
Force Majeure: We are not liable for delays/failures caused by events beyond our reasonable control.
16. Closing
By using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
