MovIQ Health Terms of Service

Welcome to MovIQ Health. These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” or “User”) and GaitLab LLC, doing business as MovIQ Health (“MovIQ Health,” “MovIQ,” “we,” “our,” or “us”).

These Terms govern your access to and use of the MovIQ Health website, assessment services, digital dashboard, reports, consultations, and any related features or services we provide (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree, you must not access or use the Services.

MovIQ Health provides biomechanical assessments designed to identify fall risk and promote active aging. Our Services are informational and educational only and are not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional with any questions you may have regarding your health or medical condition.

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing, booking, or using the Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. These documents collectively establish a legally binding contract between you and MovIQ Health.

1.2 Updates to Terms

MovIQ Health may revise or update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website or sending notice through email, dashboard, or other communication methods. Continued use of the Services after such notice constitutes acceptance of the updated Terms.

1.3 Supplemental Terms

Some Services may include additional guidelines or rules (“Supplemental Terms”), such as consent forms, promotional offers, or research participation agreements. Supplemental Terms are incorporated by reference, and if there is a conflict, the Supplemental Terms will control for that Service.

1.4 Third-Party Services
Our Services may rely on or integrate with third-party tools, such as payment processors, telehealth platforms, or hosting providers. These providers have their own terms of service and privacy policies. MovIQ Health is not responsible for third-party content, practices, or failures.

2. Services Provided

2.1 Assessments and Reports

MovIQ Health offers in-person biomechanical assessments at designated facilities. Assessments may include gait analysis, balance testing, and force plate metrics. Following the assessment, you will receive access to a secure digital dashboard containing Reports. Reports may include:

  • A Fall Risk Index (scored 0–100)

  • A Projected Annual Fall Frequency

  • A Window of Opportunity estimate indicating how fall risk may progress over time

  • Other biomechanical insights, benchmarks, and comparative data

2.2 Consultations

Every assessment includes a consultation with a licensed physical therapist (“PT”). The PT will:

  • Review your assessment results

  • Explain the findings and their potential implications

  • Provide general wellness-oriented recommendations for mobility, strength, and safety

These consultations are meant to support understanding and independence. They are not diagnostic medical evaluations.

2.3 Scope and Limitations

The Services are intended to provide educational insights only. They are not medical advice, diagnosis, or treatment. The PT consultation is advisory and does not replace regular care by your physician or specialist.

MovIQ Health does not provide emergency care. If you have urgent concerns, you must contact your medical provider or emergency services.

Outcomes are based on probability models and may not accurately predict individual outcomes.

2.4 User Responsibility

You remain solely responsible for your own health decisions. You agree to use Reports responsibly and consult healthcare providers before making changes to your treatment, exercise, or lifestyle based on the Services.

3. Eligibility

3.1 Minimum Age Requirement

The Services are available only to individuals 18 years of age or older. By using the Services, you confirm that you meet this requirement.

3.2 Minors

MovIQ Health does not provide Services to anyone under 18. No exceptions apply.

3.3 Geographic Restrictions

The Services are only offered in jurisdictions where MovIQ Health operates facilities and where licensed PTs are authorized to practice. It is your responsibility to ensure compliance with local laws.

3.4 Medical Considerations

MovIQ Health may decline Services if participation poses a safety risk due to health conditions, severe limitations, or other concerns identified by staff.

4. User Responsibilities

4.1 Accurate Information

You agree to provide truthful and accurate information when booking an assessment or creating an account.

4.2 Safe Participation

You agree to follow instructions from MovIQ staff and PTs during assessments. If you feel pain, dizziness, or discomfort, you must notify staff immediately.

4.3 Use of Reports

Reports and consultations are informational tools only. You may not rely on them as medical facts or as substitutes for clinical care.

4.4 Account Security

You are responsible for safeguarding your login credentials and for all activity under your account. If you suspect unauthorized use, notify MovIQ immediately.

4.5 Prohibited Conduct

You may not:

  • Misuse or attempt to reverse-engineer the Services

  • Resell or redistribute Reports

  • Provide false or misleading information

  • Use the Services unlawfully

4.6 Compliance with Laws

You agree to follow all applicable federal, state, and local laws when using the Services.

5. Booking, Payments, and Refunds

5.1 Booking

Assessments must be booked in advance through authorized MovIQ channels. Appointments are confirmed upon full payment.

5.2 Pricing

Each assessment (including the PT consultation and Reports) is priced at $249, unless otherwise stated.

5.3 Payment

Payment is required at booking. Accepted methods include debit/credit cards and other forms made available through third-party processors.

5.4 Cancellations & Rescheduling

You may cancel or reschedule at any time prior to the appointment. Your payment will remain valid for a rescheduled appointment or may be refunded if you cancel.

5.5 Refunds

Refunds are guaranteed only if:

  • Payment was made in full, and

  • The Services were not used.

Refund requests must be submitted within 30 days of payment. No refunds will be issued after Services are provided or after 30 days, whichever comes first.

5.6 Third-Party Processors

Payments are handled by third-party processors (e.g., Stripe). You are subject to their policies, and MovIQ Health is not responsible for errors or issues caused by third-party systems.

6. Intellectual Property

6.1 Ownership

All software, reports, algorithms, dashboards, branding, and content provided through the Services (“MovIQ Content”) remain the exclusive property of MovIQ Health.

6.2 License to Use

You are granted a limited, non-transferable license to access and use your Reports for personal, non-commercial purposes only.

6.3 Restrictions

You may not copy, distribute, modify, reverse-engineer, or otherwise exploit MovIQ Content for commercial purposes without prior written consent.

6.4 Feedback

Any feedback, suggestions, or ideas you provide may be used by MovIQ Health without obligation, attribution, or compensation.

7. Privacy and Data Use

7.1 Privacy Policy

Your personal information and Assessment Data are governed by our Privacy Policy, which explains in detail how we collect, use, and protect your information.

7.2 Data Collected

We collect personal and biomechanical data (“Assessment Data”) when you book or undergo an Assessment. This includes, but is not limited to, information about your gait, balance, and movement patterns.

7.3 Use of Data

Assessment Data may be used to deliver Services, generate Reports, and provide consultations. We may also use de-identified or aggregated data for research, validation studies, and product improvement.

7.4 Data Security

MovIQ Health employs commercially reasonable safeguards to protect your information. However, no system can guarantee 100% security, and you acknowledge that you share data at your own risk.

7.5 Data Sharing

We may share data only when necessary to deliver Services or comply with legal obligations. This includes:

  • Licensed physical therapists (for consultations)

  • Service providers (e.g., hosting, payment processing)

  • Regulators, authorities, or as otherwise required by law

7.6 User Rights

You may request access to, correction of, or deletion of your data by contacting us. Certain data may need to be retained for legal, regulatory, or operational purposes.

8. Disclaimers

8.1 Informational Use Only

The Services, including Assessments, Reports, and consultations, are provided for informational and educational purposes only. They are not medical advice, diagnosis, or treatment.

8.2 No Provider Relationship

Your use of the Services does not create a provider–patient or therapist–patient relationship beyond the limited consultation provided by a licensed PT.

8.3 No Guarantee of Outcomes

MovIQ Health does not guarantee prevention of falls, improvement of mobility, or achievement of any specific health results. Reports are probability-based estimates only.

8.4 “As Is” Services

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

8.5 Technology Limitations

Technical issues, interruptions, or failures may occur, including errors caused by third-party tools or platforms. MovIQ Health is not responsible for such failures.

9. Limitation of Liability

9.1 General Limitation

To the fullest extent permitted by law, MovIQ Health and its affiliates, officers, directors, employees, contractors, advisors, and agents (collectively, the “MovIQ Parties”) are not liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, personal injury, medical costs, lost profits, lost data, business interruption, or emotional distress arising out of or related to your use of the Services.

9.2 Cap on Liability

In no event shall the total liability of the MovIQ Parties to you for all claims exceed the total amount you paid to MovIQ Health for the Services that gave rise to the claim. If you did not make a payment, the maximum liability is limited to $100.

9.3 Jurisdictional Limits

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of the MovIQ Parties will be limited to the maximum extent permitted by law.

9.4 Assumption of Risk

By using the Services, you acknowledge and accept that physical assessments involve inherent risks. These may include, but are not limited to, muscle soreness, fatigue, imbalance, or falls. You voluntarily assume all such risks and agree that MovIQ Health is not liable for any resulting injuries or adverse outcomes.

10. Indemnification

10.1 Indemnity Obligation

You agree to indemnify, defend, and hold harmless MovIQ Health and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services

  • Your violation of these Terms or any applicable law

  • Your misuse of Reports or consultations

  • Any third-party claims related to your use of the Services

10.2 Defense and Cooperation

MovIQ Health reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully with MovIQ Health in defending such claims and not to settle any matter without our prior written consent.

11. Termination

11.1 Termination by MovIQ Health

MovIQ Health may suspend, restrict, or terminate your access to the Services if you:

  • Violate these Terms

  • Misuse the Services or Reports

  • Create legal, security, or operational risks for MovIQ Health or its users

11.2 Termination by You

You may stop using the Services at any time and may request closure of your account by contacting MovIQ Health.

11.3 Effect of Termination

Upon termination:

  • Your right to access the Services will immediately cease

  • MovIQ Health may deactivate or delete your account and related data, subject to applicable law and our Privacy Policy

  • Fees already paid are non-refundable unless otherwise stated in these Terms

11.4 Survival of Provisions

Certain provisions of these Terms will continue to apply after termination, including but not limited to:

  • Intellectual Property

  • Privacy and Data Use

  • Disclaimers

  • Limitation of Liability

  • Indemnification

  • Governing Law and Dispute Resolution

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.

12.2 Venue

Any legal action or proceeding that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Clark County, Nevada.

12.3 Arbitration

Except for disputes that qualify for small claims court, you and MovIQ Health agree to resolve all disputes through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Las Vegas, Nevada, unless both parties agree otherwise.

12.4 Class Action Waiver

All disputes must be resolved on an individual basis. You waive the right to participate in a class action, class arbitration, or other representative action against MovIQ Health.

12.5 Jury Trial Waiver

Both you and MovIQ Health waive the right to a jury trial in any legal proceeding related to these Terms or the Services.

12.6 Equitable Relief

MovIQ Health may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights, without first engaging in arbitration.

13. Changes to Terms

MovIQ Health reserves the right to update these Terms at any time. Changes take effect upon posting or notice. Continued use of the Services constitutes acceptance of the updated Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Supplemental Terms, constitute the entire agreement between you and MovIQ Health and supersede all prior agreements or communications.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Failure by MovIQ Health to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from MovIQ Health. We may assign or transfer our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

15.5 Headings

Section titles and headings are included for convenience only and do not affect the meaning or interpretation of these Terms.

15.6 Force Majeure

MovIQ Health shall not be liable for any delay or failure in performance caused by events beyond our reasonable control, including natural disasters, acts of government, labor disputes, internet or telecommunications outages, or power failures.

16. Closing

By using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
